Noise Impact Statements: The council may require any person <br />applying for a change in zoning classification or a permit or license <br />for any structure, operation, process, installation, or alteration, or <br />project that may be considered a potential noise source to submit a <br />noise Impact statement on a form prescribed by the Council. It sh a l I <br />evaluate each such statement and take its evaluation into account In <br />approving or disapproving the license or permit applied for or the <br />zoning change requested. <br />C. Criminal Penalties. Every person who violates an y provisio <br />of this ordinance is gu i I ty of a misdemeanor and sha I I, upon convi cti onn <br />be subject to a fine of not more than $500.00 or imprisonment for a term <br />not to exceed 90 days, or both, plus, in either case, the costs of <br />prosecution. Each act of violation and each day a violation occurs or <br />continues constitutes a separate offense. <br />207.040. Vartan .esAny person may apply to the City Council for <br />a variance from the requirements of this ordinance prior to doing those <br />acts which would otherwise constitute a violation of this ordinance. Failure to remove the trees by said date will cause the Clty to <br />remove said trees and all costs for the inspection, removal or treatment <br />of trees shall be charged against the property owner <br />ed however, <br />such costs may be assessed against the property pursuant dto Section <br />210:030. <br />242 <br />
