R
r
DATE:
TO:
FROM:
MEMORANDUM
July 20, 1988
Craig A. Waldron
Rick Jopke
SUBJECT: EAW Process
EQB Rules pxah, ibit all governmental units from making a final
decision granting any permit or, approval necessary to projects
until Environmental Review is completed. This prohibition covers
preliminary plat approval, conditional use permit, P.U.D.
approvals and zoning changes if the zoning change request is for
a specific project. Permits can be denied however.
The Can -American project and Brutgers project on the Concordia
School site meet the mandatory EAW threshold for residential
development. The threshold is 150 or more unattached or 225 or
more attached units. Both of the project have a total of more
than 225 attached units. Therefore the city cannot give final
approval to these projects until the environmental review is
complete.
I have attached a timeline of the EAW process and a timeline
showing specific dates which shows it would take approximately 60
days to complete the process if an EAW was completed by
August 1, 1988.
As I understand, a petition is or will be circulated in the
neighborhood requesting an environmental review. According to
EQB Rules, a petition with only 25 signatures is necessary to
request an EAW. The City would then have to decide whether or
not to do an EAW.
