AGREEMENT BETWEEN CITY OF ROSEVILLE AND DISCUS OF ROSEVILLE, INC. THIS AGREEMENT made and entered into this day of May, 1984, by and between DISCUS OF ROSEVILLE, INC. (hereafter "Discus"), and the CITY OF ROSEVILLE, Minnesota (hereafter referred to as the "City"). WHEREAS, Discus has applied to the City for +one rezoning of a portion of the property in the City at 3561 North Snelling (Polar Food Locker site) from R-1 to B-2 and another portion of said property from B-1 to B-2 and for the issuance of an on -sale intoxicating liquor license for said property, where Discus intends to operate a restaurant. WHEREAS, the parties believe that the current roadway servicing said property is insufficient to handle traffic which is anticipated to be generated by the construction of a restaurant at said site and that certain improvements to said roadway should be made. WHEREAS, by this Agreement, the parties intend to establish their various rights and obligations with regard to the dedication of right-of-way, the petitioning for said improvements, and the payment of said improvement costs in the event that the rezonings and the liquor license are granted. NOW, THEREFORE, IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS: 1. In the event that the City Council of the City, after following appropriate procedures, rezones a portion of the property at 3561 North Snelling from R-1 to B-2 and a portion from B-1 to B-2, as requested by Discus, and further issues an on -sale intoxicating liquor license for the premises at 3561 North Snelling, Discus shall:
