I stand corrected if I missed the <br />cited above. The objective is to <br />eliminate unnecessary debate and to place definitions on a common <br />denominator. Further, I believe it to be appropriate for the council, <br />on behalf of the community, to insist on protective covenants to be <br />placed on the property as a condition for approving the rezoning and <br />also the specific project. These protective covenants should include, <br />but not be limited to, the following as a project defined as: . <br />1) Condominiums of market rate or not less than $__, per unit <br />for those persons defined as elderly. <br />2) The project shall contain not less than units, nor more than <br />units, ranging in size from _ to square <br />feet. <br />3) The project shall be exclusively for those eligible for housing for <br />the elderly as originally proposed and shall not be converted to <br />nursing home, hospital, subsidized housing for rent or ownership <br />nor shall it be converted in part or in whole to general apartment <br />use for lease or for sale to the general public. <br />4) The project shall be built and maintained in accordance with <br />those plans approved and dated <br />5) The project shall be built and placed on the site in accordance <br />with the resolution and specifications, set back• height, <br />roof line , landscaping and those conditions stipulated by the <br />planning department and agreed to by the developer, attached hereto <br />and made a part hereof. <br />
