When the first building was constructed at the north end of <br />the property in question, a public easement for right-of-way <br />was dedicated which could have provided for the extension of <br />Anthony Lane easterly from the City of St. Anthony. You <br />will note the distance of this easement on the attached copy <br />of the plat for the properties west of Patton Road. <br />Ultimately, the properties to the west and those to the east <br />were developed by the applicants and Patton Road was platted <br />and built as shown on the attached plat drawing. Major <br />portions of the east easement initially r..,ovided an area <br />occupied by a drainage pond which serves the properties in <br />the immediate vicinity. <br />Thus, the applicants quite appropriately are requesting the <br />vacation of the initial easement. Attached is a copy of a <br />letter to Mr. Drown dated August 6, 1985, from Daniel <br />Commers and Paul Klodt outlining that request.. <br />2. You will recall that the establishment of Patton Road was <br />done with a considerable cooperative effort between the <br />developers and the City, wherein the City acquired the <br />right-of-way, built the roadway and utilities, and assessed <br />the cost to the benefited properties. The vacation of the <br />previously established public road easement for the possible <br />future extension of Anthony Leine was overlooked at that <br />time. Thus, the action requested is a housekeeping detail <br />for the purpose of eliminating the public easement no longer <br />required. <br />
