MR&SR <br />AFNNNN Norwest Bank Minneapolis, N.A. <br />XNNNN <br />AK BANKS Eighth Street and Marquette Avenue <br />NNITRN Minneapolis, Minnesota 55479 <br />6121372-8123 <br />September 25, 1986 <br />Commers-Klodt <br />50 Groveland Terrace <br />Minneapolis, MN 55403-3696 <br />Attention: Paul Klodt <br />Re: $2,900,000 Construction Loan from Norwest Bank <br />Minneapolis, National Association (the "Bank") <br />to Commers-Klodt (the "Borrower") (Roseville <br />Business Commons II) <br />Gentlemen: <br />The Bank and the Borrower have conducted a closing <br />today of the above -referenced transaction. In connection <br />therewith, this letter will evidence the understanding of the <br />Bank with respect to the matters set forth below. <br />The Bank acknowledges that the Combination Mortgage, <br />Security Agreement and Fixture Financing Statement of even date <br />herewith (the "Mortgage") to be recorded by Title Insurance <br />Company of Minnesota ("Title") covers certain property in excess <br />of the property the Bank and the Borrower originally intended the <br />Mortgage to cover. Accordingly, the Bank and the Borrower have <br />agreed as follows: <br />(i) The Bank shall release the lien of the Mortgage <br />from the property legally described as "Parcel B" in Exhibit A <br />attached hereto ("Parcel B") upon the satisfaction of the follow- <br />ing conditions: (1) the completion of any replatting, subdivision <br />or other action necessary to subdivide the Mortgaged Property, as <br />defined in the Mortgage, so that the <br />portion <br />Property which shall remain subject totheMorrtgage will gnot dbe <br />in violation of any applicable platting, subdivision or develop- <br />ment laws, rules, regulations or ordinances; and (2) the Bank <br />shall receive an endorsement from Title, in form and substance <br />satisfactory to the Bank, to the effect that the Mortgaged Property <br />so subdivided shall be in compliance with all applicable platting, <br />subdivision and development laws, rules, regulations and ordinances; <br />
