PLANNING REPORT <br />DATE: 3 December 1986 <br />CASE NUMBER: 1715 <br />APPLICANT: Commers-Klodt <br />LOCATION• East of Patton Road (see <br />sketch) <br />ACTION REQUESTED: Variance to Side Yard Setback <br />PLANNING CONSIDERATIONS: <br />1. The applicant has recently platted the two lots on the east side of <br />Patton Road. Referring to the copy of the drawing attached submitted <br />by the applicant indicating the existing and proposed development along <br />Patton Road, these two lots are on the righthand side of the drawing. <br />The larger of the two lots (at the northeast corner of Patton Road and <br />County Road C) is occupied by a hew building under construction. The <br />applicant proposes to build a second structure on the northerly most lot <br />on the east side of Patton Road. <br />2. The proposal is to construct a common driveway between these two <br />lots. We have placed a red dot on the sketch where this driveway <br />enters Patton Road. <br />3. The alternative is to <br />have two driveways side by side. <br />Where possible, <br />we recommend the combining <br />of such driveways so as <br />to reduce turning <br />conflicts and increase <br />the continuity of the boulevard <br />green <br />area along <br />a street right-of-way. <br />Where a single developer (as in this <br />case) owns <br />both lots, such combination <br />of driveways is feasible. <br />Where <br />there are <br />separate owners, of <br />course, such combination of driveways <br />is usually <br />difficult to achieve. <br />4. There is normally a 5 foot setback contiguous to a property line, in <br />this case the side lot line. A joint driveway, then, requires a variance <br />to the 5 foot setback requirement, thus allowing for the common <br />driveway solution. <br />5. The Planning Commission and Council may wish to consider approval of <br />a variance to the side yard setback Co Lots 1 and 2, Patton Business <br />Second Addition, with the conditions that appropriate joint easements <br />will be prepared and recorded providing for joint access rates to the <br />affected driveway area. <br />
