Ranum <br />FREDRIKSON & BYRON <br />1100 International Centre <br />900 Second Avenue South <br />Minneapolis, MN 55402-3397 <br />RE: INDIANHEAD TRUCK LINES, I NC . <br />Our File No. 1011.19 <br />Dear Ms. Ranum: <br />This confirms our telephone conversation of approximately three <br />weeks ago. <br />Your letter of September 9, 1987 to Jim Andre questions the <br />Roseville City Council's action on August 11, 1986 rezoning <br />property owned by Indianhead from I--1 to B-4 . <br />We reviewed this matter with Craig Waldron, on the City Staff. <br />He informs us that all notices of the public hearing were <br />properly sent. That included a notice sent to the legal --owner of <br />the property in question. Hence, in our opinion, the action of <br />the council on August 11, 1986 was, in all instances, valid. <br />Minn. Stat. Section 462.357, Subd. 4 states: <br />"...Amendments to zoning ordinances to be initiated <br />by the governing body, planning agency or by petition of <br />affected property owners...". <br />Indianhead Truck Lines is free to file their own petition to <br />rezone the property to any classification they desire. I would <br />also recommend that any filing fee for such application be waived <br />and the rezoning initiated by the governing body. <br />However, before any further hearings are involved I would <br />strongly recommend that the owners of the property contact Craig <br />Waldron, Director of Economic Development for the City of <br />Roseville. <br />
