Ranum
FREDRIKSON & BYRON
1100 International Centre
900 Second Avenue South
Minneapolis, MN 55402-3397
RE: INDIANHEAD TRUCK LINES, I NC .
Our File No. 1011.19
Dear Ms. Ranum:
This confirms our telephone conversation of approximately three
weeks ago.
Your letter of September 9, 1987 to Jim Andre questions the
Roseville City Council's action on August 11, 1986 rezoning
property owned by Indianhead from I--1 to B-4 .
We reviewed this matter with Craig Waldron, on the City Staff.
He informs us that all notices of the public hearing were
properly sent. That included a notice sent to the legal --owner of
the property in question. Hence, in our opinion, the action of
the council on August 11, 1986 was, in all instances, valid.
Minn. Stat. Section 462.357, Subd. 4 states:
"...Amendments to zoning ordinances to be initiated
by the governing body, planning agency or by petition of
affected property owners...".
Indianhead Truck Lines is free to file their own petition to
rezone the property to any classification they desire. I would
also recommend that any filing fee for such application be waived
and the rezoning initiated by the governing body.
However, before any further hearings are involved I would
strongly recommend that the owners of the property contact Craig
Waldron, Director of Economic Development for the City of
Roseville.
