In my opinion ;such a letter of guarantcac does not <br />satisfy the requirement of the landscape bond. <br />The only way the letter of guarantee may be accepted would be for <br />the matter to be brought hack before the City Council For an <br />amendment to the special use permit condition. If that is done, <br />I would recommend against use of the letter of guarneitee beicnuse <br />there is no security for performance of the guarnnte+e if the <br />developer fails to perform. The most likely circumstance where <br />the City would be making a claim against either the landscape <br />Uond or the letter of gu manta~.• would be wherrc the developer <br />failed to put In the proper landsea,aping.
