0. <br />4. Council Review and Comment. if the chairman initially <br />determines that a proposed comprehensive plan amendment has <br />no potential impact upon any of the metropolitan systems <br />plans, the chairman's notice to the local governmental unit <br />shall state that the Councii intends to review and comment <br />on the proposed amendmen*: and shall also state that the <br />amendment may be placed into effect at any time. The <br />Council shall have 60 days from receipt of the proposed <br />amendment to review and comment upon the apparent consist- <br />ency of the proposed amendment with other adopted chapters <br />of the Metropolitan Development Guide pursuant to Minn. <br />Stat. 473.175, subd. 1. The review comments shall be <br />transmitted to the local governmental unit regardless of <br />whether that unit has finally approved the proposed <br />amendment. The Council may waive its review and vocmment <br />authority subsequent to the chairman's initial <br />determination. <br />5. Council Review for System Impact. If the chairman <br />initially etermines that a proposed local plan amendment <br />has potential impact on any of the metropolitan system <br />plans, the chairman shall mail a notice to the local govern- <br />mental unit within 10 working days of receipt of the <br />proposed amendment stating that the amendment has potential <br />impact and may not be put into effect until Council review <br />is completed. The Council shall have 90 days from receipt <br />of the proposed amendment in which to complete its review, <br />pursuant to Minn. Stat. 473.175, subd. 1. If the Council <br />requires a modification to the proposed amendhent, the <br />amendment may not be put into effect until the Council has <br />made its f inal decision pursuant to Minn. Stat. 473.866 <br />(1978) . Failure of the Council to act within 9%) days of <br />receipt of the proposed comprehensive plan amendment shall <br />be deemed to constitute a finding of no substantial impact <br />on or no substantial departure from metropolitan systems <br />plans. The Council shall mail notice of its action to the <br />local governmental unit within three working days of the <br />action. <br />6. Criteria for Determining Potential Systems impact. The <br />chairman shall utilize the of ow ng cr ter a � making the <br />initial determination pursuant to No. 3 above: <br />a. Whether the proposed amendment may result in a change <br />in the timing, staging, capacitvs or service area of <br />the approved local facilities in the sewer policy plan <br />or comprehensive sewer plan (CSP) for which the Metro- <br />politan Waste Control Commission may require a CSP <br />amendmen t; <br />b. Whether the proposed amendment may result in an <br />effluent flow from the service area in which the pro- <br />posed change (s) is (are) located that exceeds the 1990 <br />or five-year staging forecasts originally projected in <br />the local sewer policy plan; <br />3 <br />
