G. Fugitive Emissions. To control fugitive emissions on the <br />project, the second permlttee shall require that all <br />developers and builders, as a condition of all building <br />and/or grading permits for any portion of the project, for <br />which the second permlttee may authorize construction, <br />comply with the conditions below. If the first permlttee Is <br />the developer and/or builder, the first permlttee shall <br />either perform the Items set forth below or require all <br />subsequent developers anc: their builders as a condition of <br />any lease, sale, or development agreement comply with the <br />conditions below: <br />1. spray construction areas and haul roads with water, oil, <br />calcium chloride or other effective preparations to the <br />extent necessary to minimize fugitive emissions, <br />especially during periods of steady winds exceeding 30 <br />miles per hour or high levels of construction activity; <br />2. wet ramps at the construction site and wash the streets <br />surrounding the construction site on a dally basis, as <br />necessary, to limit dust reentrainmen'., except when the <br />streets are wet from precipitation or when such actions <br />will result In freezing of the agent liquids during <br />freezing temperatures; <br />3. apply surface hardening agents. wetting or chemical <br />agents, foam agents and oils so they do not cause <br />groundwater or surface water contamination In violation <br />of any applicable water pollution control skatute or <br />rule; <br />4, take any practical measures to prevent avoidable amounts <br />of particulates from becoming airborne from trucks <br />hauling materials to and from the site; <br />5. cease particulate -producing lictivitles during periods or <br />steady high winds exceeding 30 miles per hour; and <br />$. take any additional measures required by Minnesota Rules <br />Part 7005.0550, "Preventing Particulate Matter from <br />Becoming Airborne." <br />H. Annual Reporting of Land Uses. The second permlttee shall <br />submit to the Director an annual report of land uses for <br />construction authorized by this permit. The report shall <br />contain the types Of land use built or under construction, <br />their existing or anticipated square footage, and number of <br />actual associated parking spaces to the project area. The <br />first report shall be submitted by December 3, 1990 and by <br />the 3rd of December each year thereafter, until all project <br />construction is completed. <br />-7- <br />
