E. APPLICABILITY of CHAPTER 116D <br />This permit is Issued pursuant to requirements contained in <br />Chapter 116D.03 (a), (c), and (d), particularly with respect <br />to: <br />Coordination with other government agencies concerning air <br />quality and traffic forecasts. <br />F. PRELIMINARY DETERMINATIONS <br />The Director has determined that a final permit should be <br />Issued, subject to Special and General Conditions contained <br />therein, Inasmuch as the permit meets the requirements of <br />Minnesota Rules stated In C. <br />G. PROCEDURES FOR REACHING A FINAL <br />DECISION ON THE PERMIT <br />The staff has determined, pursuant to changes In rules <br />published In the State Register of April 10, 1989, and <br />taking effect as of April 17, 1989, that no public comment <br />period Is required. <br />Procedures for requesting a public Informational meeting or <br />contested case hearing are specified In Minnesota Rules <br />Parts 7001.0120 and 7001.0130. <br />Nature of the two procedures: <br />A public Informational meeting Is designed to clarify and <br />resolve Issues concerning the preliminary determination to <br />Issue a permit. A contested case hearing Is designed to <br />determine whether a material Issue of fact or of the <br />application of facts to law related to the preliminary <br />determination or the terms of the permit, In areas under the <br />Agoncy's jurisdiction, and having a reasonable basis <br />underlying Issues of fact or law, should change the <br />preliminary determination of Issuance, or the terms of the <br />permit. <br />The Director has determined that no draft permit will be <br />Issued, pursuant to the State Register notice of April 10, <br />IM <br />
