<br />DEVELOPER IMPROVEMENTS
<br />5.1 DEVELOPER IMPROVEMENTS. The Developer shall install, at
<br />its own cost, the Developer Improvements in accordance with the
<br />Development Plans. The Developer Improvements shall be completed
<br />by the dates shown on Exhibit H subject to Force Majeure provided,
<br />however, that: the r.ompletioli dates on Exhibit H shall only be
<br />=xtended on account of a Force Majeure if Developer provides the
<br />city with Formal Notice of the occurrence of Force Majeure within 5
<br />days of such occurrence and the completion dates set forth on
<br />Fx►tibie. H shall only be extended for a period of time equal to the
<br />,111nation of the occurr(-nce of the Force Majeure. Failure of the
<br />city to promptly take action to enforce this Development Contract
<br />after expiration of time in which the Developer Improvements are to
