Owasso Blvd. <br />Roseville, Minnesota 55113 <br />February 2, 1989 <br />Mr. Gordon Beseth <br />Chief Building Official <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, Minnesota 55113 <br />Dear Gordy: <br />Thank you for your letter concerning proper drainage between <br />our home and the Cartwright residence. As you correctly stated, <br />last fall the Cartwrights removed a rock retaining wall located <br />two feet inside our property line. This resulted in our fence <br />collapsing and the need for us to install a new landscape timber <br />retaining wall to maintain the original grade. We had discussed <br />this issue with you prior to the installation of the wall and <br />the replacement of the fence. Had the Cartwrights not removed <br />the original wall, there would not have been the necessity for <br />the present retaining wall. The installation was completed <br />in November. At the time, a swale was incorporated and three <br />to four inches of landscape wood chips were placed on two- <br />thirds of the area between the two houses. In warmer spIring <br />weather, a small concrete pad will be poured and the final <br />landscaping with additional plantings will be completed. We <br />do expect some settling and this will be addressed in the spring. <br />Of concern are the two Cartwright downspouts which are direct-odt <br />toward our retaining wall. These are within perhaps a foot and <br />a half of our property and collect all the water from approx- <br />imately 60 feet of their roof. In additionp the grade is eloped <br />toward our retaining wall instead of away from it. This needs <br />to be corrected or the new wall could be undermined. <br />As you know, the Cartwright hone: is within six inches of our <br />property line and in violation of city code. This resulted <br />from an apparent misrepresentation by the Cartwrights to the <br />city and was uncovered as a result of our recent survey. Thin <br />violation has a significant negative impact on the property <br />values of the neighborhood. This is a similar situation to <br />the Lake: Josephine property, bt:it in much greater violation. <br />
