r
January 13, 1989
Mr. Stephen Lyons
Merle's Construction Co. Inc.
860 Randolph Avenue
St. Paul, MN 55102
Dear Mr. Lyons:
I was recently contacted by Mr. and Mrs. Syring concerning an
addition which they had contracted with you to build. The
Fyri,ng' s have apparently now decided not to go forward with the
addition and you have refused to give them their deposit back.
According to the Syrings, you have stated that the City of
Roseville is at fault and, therefore, you shouldn't have to give
back the deposit.
I want to make it clear that the City of Roseville is not at
fault. The City has ordinances which must be followed. The
City, in fact, granted a substa.ltial variance in this case to
allow a 12 foot by 16 foot addition. It is the responsibiliLy of
contractors to check out ordinances to be sure that what they
propose to clients is in compliance with City ordinances. if the
contractor orders materials prior to obtaining proper permits, it
is a risk which must be assumed by the contractor, especially
since in all likelihood, the materials can be used at another
job.
In my opinion, the Syring's are entitled to a refund of at least
a major portion of their deposit.
Sincerely,
" -3
Rick Jopke
Planning and Zoning
City of Roseville
:cf
Administrator
2000 CIVIC C1;\'1'ER l)ItIVE, - IiOSEIVILLE, - MINN 'SOYA - 55113 - 012-490- 200
