REQUEST FOR COUNCIL ACTION <br />DATE: 10-18-88 <br />ITEM NO.: <br />Department Appr)pval: Manager Reviewed: Agenda Section: <br />j /// J// Report and Recommendations <br />Item Descrip 'on: John Jaeger request for a minor variance at <br />996 County Road B2. <br />The Minor Variance committee met on October 19, 1988 and considered <br />John Jaeger's request for a minor variance to allow expansion of the <br />existing dwelling at 996 County Road B-2. Mr. Jaeger has added a 21 <br />foot six inch by 24 foot addition onto the front of the existing <br />house which does not meet the rear yard setback requirement of 30 <br />feet. The existing dwelling has a rear yard setback of 6 feet. <br />The City granted a variance in 1977 which allowed Mr. Jaeger to <br />construct a new garage forward of the house with the condition that <br />once a new home is constructed on the site, that the older home and <br />garage will be removed. The minor variance committee was concerned <br />that the current variance request was not consistent with the <br />aforementioned condition and whether or not the committee had the <br />power to contradict that condition by recommending approval of this <br />variance request. The applicant stated that his intentions may have <br />been misrepresented in the previous request because he has not <br />intended to build a new home. He stated, however, that if he were <br />to build a new house, he would build it in compliance with City <br />requirements. <br />The Minor Variance Committee unanimously recommend that the minor <br />variance request be granted. The committee further recommends that <br />the Council review the previous variance and determine if this <br />variance is appropriate. <br />All impacted neighbors supported the project. <br />Requirement: 30 feet <br />Proposed: 5 feet <br />Variance: 25 feet <br />% Variance: 83% <br />COUNCIL ACTION REQUESTED: Motion to app ove/deny John Jaeger's <br />request for a minor variance at 996 <br />County Road B2. <br />
