Thomas Brennan. <br />2. Jurisdictional statement: <br />This is an appeal from the entry of a judgment on February <br />6, 1990. Jurisdiction is based upon Rule 103.03(a). <br />3. State type of litigation. -and designate any- statutes at <br />issue: <br />This is a municipal litigation case involving the <br />application of the City of *Roseville's Zoning Regulations <br />and the provisions of M.S. 462.357, Subd. 6(2). <br />4. Brief description of claims, defenses, issues litigated, and <br />results below: _ <br />Rekuski remodeled his home. A portion of the remodeled home <br />was constructed within an area which was to be used as a <br />side yard setback pursuant to the Zoning Regulations of the <br />City of Roseville. Rekuski's request for a variance to the <br />side yard setback requirement was denied by the Roseville <br />City Council. The City of Roseville commenced an action to <br />require Rekuski to comply with its Zoning Regulations and to <br />move his home to accommodate the appropriate side yard <br />setback. <br />
