other improvements that do deviate from the drawings shown on <br />Exhibit "A", that his continued right to maintain the house in <br />its present location will be terminated. <br />4. That in the event that the building department of <br />the City of Roseville certifies to the City Council by November <br />20, 1991, that the improvements shown on Exhibit "A" have been <br />made and further in the event that the City Council is informed <br />by the undersigned that the payment of damages has been made, <br />then in that event, the City Council will instruct the City <br />• Attorney to dismiss the lawsuit now pending against Frank Rekuski <br />by the City of Roseville identified as follows: <br />Ramsey County Court File No. C6-89-5680 <br />Court of Appeals File No. C4-90-1024 <br />Minnesota Supreme Court File No. C4-90-1024 <br />5. That in the event the City grants a variance that <br />does not contain all of the above conditions, then we do not give <br />our consent to the variance.
