ti <br />M E M O R A N D U M <br />DATE: May 12, 1989 <br />TO: Craig Waldron <br />FROM: Rick Jopke <br />SUBJECT: Proposed ordinance amendments relating to outside <br />display of merchandise. <br />Attached is background information concerning the proposed <br />ordinance amendment concerning outside display of merchandise. <br />The major purposes of these ordinance amendments are to clarify <br />the types of outside storage which would be permitted and to <br />allow individual property owners to determine the type of outside, <br />display of merchandise which is necessary for their businesses <br />.and to submit those plans to the City for approval through a <br />special use permit process. The ordinance sets up a number of <br />general conditions which must be met for the Council to grant <br />such a special use permit. These conditions are outlined in the <br />attached materials. <br />At th:� rast council meeting, there was some concern expressed <br />about the effect of these new regulations on existing businesses. <br />Much of the outside di -splay which is currently occurring in the <br />community is in fact illegal by our curr ordinance standards. <br />Ci sta een en orci rdinanc.es because of <br />the rev essi�ng�ofthe roposed new ordinance <br />requiremes. es ode display, which are occurring, <br />llegal, include the outside display of lawn mowers, <br />snow blowers, and similar equipment at hardware stores and the <br />exterior display of non -automobile related merchandise at <br />gasoline service stations. These types of illegal displays could <br />be made legal if the property owners applied for and were granted <br />a special use permit by the City under the terms of the new <br />ordinance. <br />At the past council meeting, concern was expressed about the <br />inconvenience and the potential high fees which the existing <br />business would be faced by going through the special use permit <br />process contemplated in the new ordinance. The process called <br />for in the ordinance is a special use permit process. This would <br />require review by the Planning Commission and City Council but as <br />previously mentioned would allow business owners to tailor the <br />outside display specifically to meet their needs. While this <br />process would take some time, it would result in an arrangement <br />that would meet the needs of the individual property owner. The <br />fee that is currently required for special use permit is $200 and <br />this is a one time fee. Once the special use permit is granted, <br />the property owner can continue to have outside display in <br />accordance with the approved plan indefinitely. No further <br />approvals are required unless the property owner needs to make a <br />
