BRIDGE October 18, 1988 SCOTTB.CROSSMAN Mr. Craig Waldron Director/Economic Development City of Roseville 2660 Civic Center Drive Roseville, MN 55113 Re: Tax Increment Financing Our File No. 1011.19 Dear Mr. Waldron: You inquired yesterday, substantially the following: What is the effect of the planning commission of the City of Roseville moving to "table" a recommendation to approve a tax increment financing? We are aware of no statute of the State of Minnesota or ordinance of the City of Roseville requiring that the planning commission of the City of Roseville consider the tax increment financing plan. This includes establishing any tax increment financing district or related type district. Minnesota Statutes do require that amendments to the zoning ordinances be referred to the City planning commission. Minnesota Statutes 5462.357, subd. 4: "...Subd. 4 Amendments. An amendment to a zoning ordinance may be initiated by the governing body, the planning agency, or by petition of affected property owners as defined in the zoning ordinance. An amendment not initiated by the planning agency shall be referred to the planning agency, if there is one, for study and report and may not be acted upon by the governing body until it has received the recommendation of the planning agency on the proposed amendment or until 60 days have elapsed from the date of reference of the amendment without a report by the planning agency." s „
