PLANNING REPORT <br />DATE: 3 February 1988 <br />CASE NUMBER: 1820 <br />APPLICANT: NIPS, Inc. <br />LOCATION: West of Snelling Avenue, <br />Northerly of Skillman (see <br />sketch) <br />ACTION REQUESTED: Amendment of Comprehensive <br />Plan, Rezoning from R-2 and <br />B-1 to R-3A, and B-1 to B-39 <br />Special Use Permit for <br />Planned Urit, Development, <br />and Preliminary Plat <br />PLANNING CONSIDERATIONS: <br />1. This property consists of 4.59 acres and includes ',he existing McDonaid's <br />site and the Kentucky Fried Chicken site directly to the north. The <br />entire parcel has been owned by Mr. Boots Halverson, the founder and <br />owner of the McDonald's franchise in Roseville. He recently added an <br />existing duplex lot to the northwest corner of the site fronting on <br />Eldridge Avenue. <br />2. Attached is a copy of the zoning map indicating the existing zoning of <br />the land. You will notice that approximately half of the property is <br />zoned B-1 (the westerly half) and the easterly half- is zoned B-3. The <br />Preliminary Plat proposed divides the land into three parcels indicated <br />as lots 1, 2, and 3. Lot 1 's proposed to be rezoned from R-2 and <br />B-1 to R-3A. At one time apartments were permitted c a Special Use <br />in the B-1 District, but that is no longer the case. You will note that <br />the properties to the north and to the south of the property in question <br />are now zoned B-1 and are developed for apartment use. Therefore, <br />the proposed zoning is consistent with the existing pattern. The portion <br />of Lot 2 (occupied by the McDonald's structure) will be rezoned from <br />B-1 to B-3. This lot will consist of 1.73 acres. Lot 3 is occupied by <br />the Kentucky Fried Chicken building and is already zoned B-3. <br />3. The owner of the property has E buy and sell arrangeniant with the <br />McDonald's folks. He must be offer to McDonald's the first right of <br />refusal in the event of a sale. TI -refore, he proposes not to sell the <br />property, but to develop the land it multi -family housing purposes <br />utilizing the existing duplex lot from ig on Eldridge as access to the <br />property. The staff has reviewed the preliminary plans for this project <br />on several occasions and has encouraged the developers to utilize the <br />property for some constructive use rather than leave it vacant. The <br />basic two options were to develop an office building on the site, or to <br />develop the land for multi -family purposes. <br />
