pursuant to a speciEic piece of legislation b-y Congress which, in <br />eEEect, told the government to set up a reserve on Rice Lake in <br />northern Minnesota. The Am. Jur. article on eminent domain, 26 <br />r <br />Am. Jur. 2d Eminent Domain, Section 91, indicates that absent <br />explicit statutory authority, the courts are split over the issue <br />of whether the federal government can take land devoted to a pub- <br />lic purpose, that is whether a federal purpose is always a su- <br />perior purpose. I have reviewed some of the cases cited in the <br />Am. Jur, article and also an annotation at 91 L.Ed. 221 and reach- <br />ed the same conclusion. I also looked at some later cases from <br />the Federal Digest and it indicates to me that this split is <br />still in existence. However, I think there is a slight trend <br />toward the rule that a specific grant of the power of eminent <br />domain authorizes taking of public as well as private property, <br />even without a specific statute saying go build a Post Office <br />in Roseville, Minnesota, on the site of a former school." <br />IV. WHAT IS GOING ON IN ROSEVILLE NOW. <br />I spoke with Bruce Davison in the Local Post Office Eminent <br />Domain and Real Estate Division. He told me that he knew nothing <br />about any plans to acquire a school in Roseville for use as a <br />Post Office. Davison indicated that any eminent domain activi- <br />ties which would be going on in Minnesota would be handled <br />through the regional office in Chicago. I called Nick Kline in <br />Chicago. Kline told me that it was his office that would be han- <br />dling any condemnation procedures of this nature and he knew noth- <br />ing about any moves to condemn the Lexington School in Roseville. <br />Davison's number is 851-1130 and Kline's number is (312)765-4988.. <br />:4 <br />�:i <br />
