<br />8. Post roads.
<br />Congress has established the following as post roads: the waters of the
<br />United States during the time the mail is carried thereon; railroads or parts
<br />of railroads and air routes in operation; canals during the time the mail is
<br />carried thereon; public roads, highways, and toll roads during the time the
<br />mail is carried thereon; and letter -carrier routes established for the collection
<br />and delivery of mail." The states cannot interfere with the control of post
<br />roads and routes by the Federal Government, and ,ts power to select, establish,
<br />and declare such roads and routes." Thus, it h, s been held that a state
<br />cannot impose a toll on wagons, carriages, stages, or other modes of convey-
<br />ances carrying United States mail;YO nor ca a state restrict the number of
<br />conveyances which the Federal Government may see fit to employ in (! -
<br />transmission of mail within and throtrt;h the tatc.r Even the operation of
<br />the telegraph on or along post roads cones wit ;n the exclu.,ive control of the
<br />Federal Government as against hostile state legislation,' although federal stat-
<br />utes which authorize the construction of telegraph lines along post roads do
<br />not affect the right of a landowner to the damage to which he is entitled for
<br />the additional burden on the fee caused by the erection of telegraph poles
<br />upon a public highway which is a post road.'
