Duane <br />Knopik, Case No. 1814 Page 2 <br />6. <br />Perhaps it is but a question of time before lots characteristic of the <br />property in question will be split. The proposal on the partof the <br />first lot (the applicants) is to do it now. Though the lot is smaller <br />than the standard for new corner lots, the lot as proposed would be <br />buildable. The normal rules of a 30 foot front yard setback (contiguous <br />to street), 10 feet on the side, and 30 feet in the rear would be <br />applicable. <br />7. <br />We have been informed that there is a possible deed restriction <br />applicable to the property in question which may prevent its division. <br />We will attempt to get further verification of this fact (or non fact) <br />prior to the Planning Commission hearing. If such a private deed <br />restriction is in fact applicable, such a restriction would take <br />precedence over the City's decision to divide the lot. In other words, <br />if the deed restriction applies, the lot could not be divided irrespective <br />of an approval by the City of Roseville. <br />Properly drawn deed restrictions are applicable through a time period <br />specified in the covenant. Such covenants, however, automatically <br />expire after forty years. <br />7. <br />The proposal is for approval of a simple lot split, platting an existing <br />platted lot into two equal lots. Additional assessments for storm <br />water, and sanitary sewer would be applied to the newly created lot. <br />
