EASEMENT AGREEMENT <br />THIS EASEMENT AGREEMENT is made the 26th day of June, 1987, <br />by Rice Street Partners, a Minnesota general partnership <br />(hereinafter called "Declarant"). <br />R E C I T A L S: <br />1. Declarant is the fee owner of the real property located <br />in Ramsey County, Minnesota, legally described as: <br />Lots 1 and 2, Block 1, and Outlot A, Transit <br />2nd Addition, Ramsey County, Minnesota <br />(hereinafter "Declarant Parcel") <br />2. Theodore L. Steichen and Patricia A. Steichen, husband <br />and wife, are the fee owners of the real property located in <br />Ramsey County, Minnesota, legally described as: <br />Lot 3, Block 1, Transit 2nd Addition, Ramsey <br />County, Minnesota (hereinafter "Steichen <br />Parcel") <br />3. Roseville-C;0 Partnership, a Minnesota _partnership <br />is the fee owner of real property located in Ramsey County, <br />Minnesota, legally described as follows: <br />Lot 1, Block 2, Transit 2nd Addition, Ramsey <br />County, Minnesota (hereinafter "Roseville <br />Parcel") <br />4. The Roseville Parcel and the Steichen Parcel adjoin <br />the Declarant Parcel. <br />5. Declarant desires to create and establish an easement <br />for ingress and egress and driveway purposes over the real <br />property legally described on Exhibit A attached hereto <br />("hereinafter the Property") and fua-ther to provide access for <br />the respective benefit of the Roseville Parcel and Steichen <br />Parcel over said Property. <br />Pursuant to the foregoing recitals, the Declarant hereby <br />states and declares: <br />1. Creation of Easement. Declarant hereby reserves, <br />grants, creates and subjects the Property to a non-exclusive <br />easement for ingress and egress, and for driveway purposes for <br />the benefit of Declarant's Parcel, Roseville's Parcel, and <br />Steichen's Parcel. <br />2. Binding Effect. The easement granted herein, reserved <br />and created, shall run with the land and be binding upon the <br />Declarant and its respective successors and assigns. <br />
