We suggest that the preliminary plat and the planned <br />unit development be approved subject to adjustment based on the <br />finalization of the right-of-way for this segment of the roadway system. <br />8. A vacation of right-of-way is requested. This involves the existing <br />service road forming the present southeasterly boundary of the site. <br />Given the appropriateness of the design concept, approval of this <br />vacation request is appropriate, subject to the effectuation of required <br />procedures with the Minnesota Department of Transportation. This <br />roadway constructed by MnDOT is a part of the local roadway system. <br />In any case, effectuation of this vacation procedure should begin with <br />the approval of the City Planning Commission and Council. <br />9. In summary, the action requested includes approval of the preliminary <br />plat, planned unit development, vacation of the right-of-way, and <br />variance to parking ratio. Consideration of approval could be considered <br />on the condition of the following items: <br />a. Approval of detailed phasing plan including parking, access, <br />utilities, grading, and landscaping. <br />b. Final review of all engineering details by the engineering staff. <br />C. Review of final grading and landscaping by staff. <br />d. Acquisition of right-of-way for the property to the north. <br />e. Approval as may be required for vacation by MnDOT. <br />f. Finalization of and/or adjustments to final development agreement <br />in conjunction with the planned unit development and tax <br />increment provision. <br />10. It should be noted that the developers and their team of assistants have <br />been extremely cooperative and helpful in working with the City <br />representatives over an extended period of time. It would appear that <br />if the development is accomplished as generally outlined, it will be a <br />highly successful addition to the community in a cruciai area of which <br />the developers and the citizens of Roseville may be proud. <br />
