The applicant's property was originally platted as Lot 8 of Block 2 <br />"Minnesota Realty Owasso Plat". The lot had .82 acres and was the <br />largest lot in the block. <br />2. The Peickert's have built a home on the westerly portion of the lot and <br />now propose to divide the property to create an additional lot to the <br />east. Attached is a drawing that illustrates the total property, as well <br />as the lot division. The drawing also indicates the location of the <br />home. <br />3. You will note that the two parcels indicated as tract "A" and <br />"B" <br />have <br />18,991 square feet <br />and 16,740 square feet, respectively. <br />The <br />lot <br />frontage for the corner lot is 106.94 feet and the frontage <br />for <br />the <br />easterly lot (interior <br />lot) is approximately 95 feet. Thus, <br />both <br />lots <br />exceed the minimum <br />frontage and lot area standards. <br />4. Attached is a copy of a portion of the section map indicating this <br />property and the lots in the immediate area. A few years ago, Lots 9, <br />10, 11, and 12 were rearranged so as to create an additional lot <br />contiguous to this property to the east. Though this division was <br />approved by the City, a final plat for this re -plat was not done. You <br />will notice on this same section map further to the east a new re -plat <br />labeled "Reiling-Owasso Heights" which was similarly approved as a <br />redivision of the land was filed as a final plat. When such plats are <br />filed, they are added to the County Section Map from which the City's <br />maps are printed. <br />5. Because these properties in this area were platted prior to May 1959, <br />when the new ordinance was adopted, this area requires a 5 foot <br />setback for side lot line. When land is redivided, the current 10 foot <br />setback applies. In this case, the applicant is applying for approval of <br />a 5 foot setback on the east side of the existing house. This was done <br />to maximize the size of the easterly lot and, thus, create a more <br />buildable, useful lot. It would appear that this is a reasonable idea. <br />6. In summary, the applicant is applying for approval of a lot division as <br />proposed in his drawing dated December 9, 1986, and for approval of a <br />side yard setback variance from 10 feet to 7.5 feet. <br />
