Department Approval: <br />REQUEST FOR COUNCIL ACTION DATE: 12/22/86 <br />Manager Reviewed: <br />ITEM NO.:--� <br />Agenda Section: <br />Hearing <br />Item Description: Carmen Dorso request for special use permit at 2814 North <br />Cleveland Avenue <br />On October 13, November 10, and November 24, 1986, the Roseville City Council <br />continued consideration of a request by Carmen Dorso for a special use permit <br />at 2814 North Cleveland Avenue. Copies of those council actions plus planning <br />commission minutes were in the recommended denial of this request are attached. <br />Although repeated efforts have been made by all parties involved to find a <br />method to resolve the differences of opinir,n, it does not appear that that will <br />be possible. The basic difference in opinion is that the staff has concluded <br />that the existing use is not in accordance with the code regulations or in the <br />best long range interest of the city, while the property owner wishes to <br />continue to obtain the revenue from renting out this space for a period of <br />several years. Although the owner has indicated a potential willingness to <br />construct an opaque fence around the storage area, the economics of this <br />construction almost automatically means that several years of continued storage <br />would have to occur to pay for the fence. This approach would, therefore, be <br />questionable. <br />The owner this week has said that they would be sending a copy of they type of <br />fence they would propose to construct, and this will be provided to the council <br />if and when it is received. ( attached) <br />Should the council ultimately conclude that they would grant the variance, the <br />second variance would need to be approved as well. The code does not allow a <br />fence over four feet in height adjacent to streets rights -of -way. Another <br />section of the code, however, requires eight foot high fences around any <br />approved storage areas. A deadline for the variance to expire should also be <br />established if the council grants the variances. <br />The council is, therefore, back tc where it was when it first began this <br />deliberation. At that time the status was as follows: <br />The Roseville Planning Commission at its October 11 1986, meeting unanimously <br />recommended denial of Carmen Dorso's request for Special Use Permit at 2814 <br />North Cleveland Avenue. The denial was based on the following findings of fact: <br />1. The use is not a legal nonconforming use, because Keystone's bumpers <br />were not stored on the site until 1977. Also, when the zoning <br />district was formed in 19599 bumpers were not stored on the site. <br />2. The illegal use has deleterious impact on the adjacent neighborhood <br />and the future development in the area. <br />RECO1411ENDED COUNCIL ACTION: <br />Motion approving/denying Carmen Dorso's request for Special Use Permit at <br />2814 North Cleveland Avenue, based on the aforementioned findings of fact. <br />
