Department Approval: REQUEST FOR COUNCIL ACTION DATE: 12/22/86 Manager Reviewed: ITEM NO.:--� Agenda Section: Hearing Item Description: Carmen Dorso request for special use permit at 2814 North Cleveland Avenue On October 13, November 10, and November 24, 1986, the Roseville City Council continued consideration of a request by Carmen Dorso for a special use permit at 2814 North Cleveland Avenue. Copies of those council actions plus planning commission minutes were in the recommended denial of this request are attached. Although repeated efforts have been made by all parties involved to find a method to resolve the differences of opinir,n, it does not appear that that will be possible. The basic difference in opinion is that the staff has concluded that the existing use is not in accordance with the code regulations or in the best long range interest of the city, while the property owner wishes to continue to obtain the revenue from renting out this space for a period of several years. Although the owner has indicated a potential willingness to construct an opaque fence around the storage area, the economics of this construction almost automatically means that several years of continued storage would have to occur to pay for the fence. This approach would, therefore, be questionable. The owner this week has said that they would be sending a copy of they type of fence they would propose to construct, and this will be provided to the council if and when it is received. ( attached) Should the council ultimately conclude that they would grant the variance, the second variance would need to be approved as well. The code does not allow a fence over four feet in height adjacent to streets rights -of -way. Another section of the code, however, requires eight foot high fences around any approved storage areas. A deadline for the variance to expire should also be established if the council grants the variances. The council is, therefore, back tc where it was when it first began this deliberation. At that time the status was as follows: The Roseville Planning Commission at its October 11 1986, meeting unanimously recommended denial of Carmen Dorso's request for Special Use Permit at 2814 North Cleveland Avenue. The denial was based on the following findings of fact: 1. The use is not a legal nonconforming use, because Keystone's bumpers were not stored on the site until 1977. Also, when the zoning district was formed in 19599 bumpers were not stored on the site. 2. The illegal use has deleterious impact on the adjacent neighborhood and the future development in the area. RECO1411ENDED COUNCIL ACTION: Motion approving/denying Carmen Dorso's request for Special Use Permit at 2814 North Cleveland Avenue, based on the aforementioned findings of fact.
