ARTICLE 1 <br />DEFINITIONS <br />Section 1.1. Definitions. All capitalized terms used and <br />not otherwise defined herei shall have the following meanings <br />unless a different ►neaning clearly appears from the context: <br />Agreement means this Agreement, as the same may be froin <br />time to time modified, amended or supplemented; <br />Certificate of Completion means the certification in the <br />form of the certificate attached hereto as Exhibit E and made a <br />part of this Agreement; <br />City means the City of Roseville, Minnesota or any <br />successor to its functions; <br />County means the County of Ramsey, Minnesota; <br />_)ev�eer means FKL, Inc., a Minnesota corporation, its <br />successors and assigns; <br />Development (District means the real property described in <br />Exhib t A; <br />Development Program means the program approved in <br />connee ionwitth the Development District; <br />Develo meat Propert means Uie real property legally <br />descrIbed" n EXhibit o this Agreement; <br />Event of Default means any of the events described in <br />section . ; <br />Project means the 4 ? . r I L - 1.4 tA4' = <br />Public Improvements means the sanitary sewer and waterinain <br />improvements moreparticularly described on Exnibi.t D attached <br />hereto which are to be constructed by the Developer in <br />accordance with the provisions of this Agreement,- <br />3 <br />
