(3) The Developer shall grant the City, at V <br />no cost, the necessary easement over the <br />Development Property for the watermain portion of <br />the Public 'Improvements; <br />(4) The Public Improvements shall be <br />constructed and the costs of construction shall be <br />paid by the Developer; <br />(5) The City shall have the right to inspect <br />the Public Improvements during construction and, <br />upon notice from the Developer that construction <br />has been completed, the City shall inspect the <br />Public Improvements to ascertain that they have <br />been completed in accordance with the plans and <br />specifications prepared therefor; and <br />(6) Upon a determination by the City that <br />the Public Improvements were constructed in <br />accordance with the plans and specifications <br />therefor, the City shall furnish the Developer <br />a statement to that effect, and the Public <br />Improvements shall be dedicated to the public by <br />the Developer, and shall thereafter be maintained <br />by the City. <br />(c) In addition to the obligation of the <br />Developer to construct the Public Improvements as set <br />forth in paragraph (b) of this Section 3.2, the <br />Developer shall have the following obligations: <br />(1) the Developer shall provide and maintain <br />private hydrants along the Public Improvements in <br />places and numbers as necessary to comply with the <br />requirements of the office of the City Fire <br />Marshall, which hydrants shall not be or become a <br />part of the Public Improvements but shall at all <br />times be maintained by the Developer; and <br />(2) the Developer shall protect the Public <br />Improvements to ensure that the construction of <br />the Project and any other construction does not <br />damage or hinder free and reasonable access to the <br />Public Improvements by the City for maintenance <br />and repair purposes. <br />9 <br />
