(2) The City shall reimburse the Developer, upon <br />completion, acceptance and dedicat.Lon of the Public <br />Improvements as set forth in Section 3.2 hereof, for the costs <br />incurred by the Developer in constructing the Public <br />Improvements from Tax Increments in the following manner: <br />(a) from the first receipts of Tax <br />Increments, the City shall be entitled to <br />reimburse itself for all legal and administrative <br />cost incurred by the City in con r�cEion with the <br />preparation of this Agreement and construction of <br />the Public Improvements, including but not limited <br />to all costs incurred in obtaining the ease ent <br />required by par4graph (d) of Section 3—ea <br />2; <br />(b) thereafter all Tax Increments as <br />received shall be applied by the City to reimburse <br />the Developer for the costs of constructing the <br />Public Improvements up to an amount not to exceed <br />$50,000; <br />(c) after provision has been made for <br />payment of all of the costs and expenses in <br />subparagraph (a) and (b) above, the City shall be <br />free and entitled to -use any Tax Increments for <br />any purpose for which Tax Inc_ r_eme_nTs may lawfully <br />be used pursuant to the act, and the City shall <br />have no obligations to the Developer with respect <br />to the use of such Tax Increments. <br />11 <br />
