CONDITIONS RELATING TO THE KEHR PROPERTY <br />1. That the development must be in compliance with the site plan <br />dated January 22, 1985. (No change.) <br />2. That the estimated cost of the sidewalks required by the <br />defendent, shall be deposited in lieu of the actual sidewalk <br />construction. (No change.) <br />3. That the plans for provision of utilities must be apr;awed <br />by staff. This includes the drainage and landscape plans. <br />The developer shall assume all the costs associated with the <br />drainage system. (Added language.) <br />4. That the water system shall be a minimum size of 8 inch <br />diameter running from County Road C, through the site, <br />connecting to the watermain in Central Park. (New condition <br />elaborating on utility approval.) <br />5. That the parking in the private street to be constructed <br />shall be prohibited from the curve to the east property line. <br />(No change.) <br />6. That until such time as the future road is constructed from <br />the east property line to Dale Street, a temporary 120 fo-)t <br />hammerhead turnaround shall be constructed at the east property <br />line to facilitate ingress and egress for firefighting and <br />other emergency or public service equiment and vehicles. The <br />area that will be used for the hammerhead needs to be properly <br />signed to prevent any parking in the hammerhead area. The <br />hammerhead is to be used solely for the movement of vehicular <br />traffic. (Addition to original conditon.) <br />7. That Kehr shall provide, to the property owners east of the <br />development and west of Dale, an easement over the private <br />street once development occurs. The developer shall assure <br />maintenance of the street by a homeowner's association to be <br />established in accomplishment of the planned unit development. <br />(Clarified language.) <br />8. That the private street shall be constructed as a seven ton <br />capacity, and have poured in place concrete curb. (New <br />condition). <br />9. That the developer shall dedicate the required ten feet of <br />right-of-way on County Road C. (New condition.) <br />10. That any significant change in the site plan must be repro- <br />cessed through the Planning Commission and Council for <br />proper consideration. (New conditon.) <br />
