RE' EST FOR COUNCIL ACTION Department Approval: DATE: 4/8/85 ITEM NO.: 9-50 Manager Reviewed: Agenda Section: Hearings Item Description: Al Kehr request for rezoning from R-1 to R-2, special use permit for Planned Unit Development, preliminary plat and variance to density at 674 County Road C. The Planning Commission, at its February 6 meeting, on a 4-Aye, 3-Nay vote, recommended approval of Al Kehr's request for rezoning from R-1 to R-2, special use permit for Planned Unit Development, and variance to density at 674 County Road C, with the following conditions: 1) That the property be developed in accordance with the site plan dated January 22, 1985. 2) That in lieu of constructing a sidewalk, the applicant shall deposit with the City an amount equal to the estimated cost of the sidewalk. 3) That utility plans be approved by staff. 4) That no parking be permitted on the private street from the corner of the "L" to the east property line. 5) That a temporary hammerhead turnaround be provided at the east property line until the street is continued to the east. 6) That provisions be made to assure the private street will be maintained by the Homeowner's Association and that an easement be provided to assure the use of the street by property owners to the east. 7) That the staff review the possibility of moving the fire hydrant located near the corner of the "L". After the Planning Commission meeting, the Council met with property owners and potential developers regarding the possible land use east of Mr. Kehr's property. Attached is the petition submitted by Mr. Kehr with his first application, and a petition recently submitted by Mr. Ed Salverda. Also attached is a letter from Terry Metz, 690 County Road C, regarding the proposal.
