The plaintiff in the instant case served the city by mail on <br />September 16th with notice of filing. The time for filing a <br />motion will expire 18 days after that date, or on October 4. <br />Because October 4 is a Sunday, the city has until Monday, October <br />5, to serve its motion papers. Minn. R. Civ. P. 6.01. <br />Scope of Review <br />The scope of appellate review is defined by Minn. R. Civ. <br />App. P. 103.04: <br />The appellate courts may reverse, affirm or modify <br />the judgment or order appealed from or take any <br />other action as the interest of justice may <br />require. <br />r <br />On appeal from or review of an order the appellate <br />courtz may review any order affecting the order <br />from which the appeal is taken and on appeal from <br />a judgment may review any order involving the <br />merits or affecting the judgment. They may review <br />any other matter as the interest of justice may <br />require. <br />Despite the broad language of Rule 103.04, Minnesota courts <br />adhere to narrower limits on their scope of review, developed <br />under cases and statutes that predate Rule 103.04. See discus- <br />sion in Sauter v. Wasemiller, 364 N.W.2d 833 (Minn. App. 1986). <br />The rule in Minnesota is that an appeal from a judgment of a <br />court sitting without a jury, where no motion for new trial has <br />been made, raises only two issues for consideration on appeal: <br />whether the evidence sustains the findings of fact and whether <br />the findings of fact sustain the conclusions of law and judgment. <br />See, e. ., Greenhagen v. Larson, 246 N.W.2d 565 (1976); Nelson v. <br />Tripp, 118 N.W.2d 805 (1962); Olcon v. Mullen, 68 N.W.2d 640 <br />(1955); Venier v. Forbes, 25 N.W.2d 704 (1947).
