Schwalbach <br />Southerly of County Road C, West of <br />Rice Street <br />Approval of Variance to Sidc and Rear <br />Setbacks, Variance to Parking <br />1. The property in question is zoned B-2 and accommodates an approximately <br />7,500 square foot, one story structure in which its owner, Ken <br />Schwalbach, has been successfully operating a retail hardware store for <br />many years. Mr. Schwalbach indicates that he is in dire need of <br />additional storage space and therefore proposes to build an addition of <br />1,000 square feet (25 feet by 40 feet) attached on the south side of the <br />building. <br />Attached is a reduced copy of a site plan prepared by Pope Associates <br />Architects indicating the proposed location of the addition. You will <br />note on the site plan that the existing structure is located two feet from <br />the north property line, and one foot from the rear property line. The <br />Zoning Ordinance as adopted in 1959, requires a 10 foot side yard setback <br />(on the north) and a 20 foot rear yard setback (on the west). Thus, the <br />structure is not conforming and in order to be expanded may be put in the <br />conforming class by the issuance of the appropriate variances. <br />2. You will note that the parking on the north side of the lot extends to the <br />property line, also requiring a variance. With respect to the <br />right-of-way lice for Rice Street on the east side of the property, the <br />site plan is drawn as indicated on the attached section map as though the <br />right-of-way is two rods (33 feet) from the center line of Rice Street. <br />In actual fact, the state sometime ago purchased an additional seven feet <br />of right-of-way. Rice Street is designated to require 49.5 feet of <br />right-of-way as measured from this center line and thus an additional 9.5 <br />feet of right-of-way would be required according to the City policy upon <br />approval of the variances and expansion of the building. This place, as <br />the parking is drawn, is within seven feet of the new right-of-way line <br />(49.5 feet from the center line of Rice Street). One of the problems with <br />respect to the dedication of this additional 9.5 feet of right-of-way is <br />that the sign as indicated on the site plan would be in the right-of-way. <br />3. You will note from the layout of the parking, that there is ample space <br />to extend the parking setback along Rice Street to the required 15 feet <br />from the new right-of-way line. If the Planing Commission and Council <br />feel that the 15 foot setback should be adhered to, this could be attached <br />
