4. Seller shall hold Buyer harmless and indemnify it <br />from all claims, costs, expenses, fees and commissions owed to any <br />realtor, agent or broker hired or engaged by Seller in connection <br />with the sale and purchase herein described. Buyer shall hold <br />Seller harmless and indemnify it from all claims, costs, expenses, <br />fees and commissions owed to any realtor, agent or broker hired or <br />engaged by Buyer in connection with the sale and purchase herein <br />described. Seller agrees to pay to Muske Company, Inc. a <br />commission of $11,000 upon the closing of the sale and purchase <br />herein described (that is, upon final consummation thereof as <br />evidenced by payment of the full purchase price and delivery of <br />the quitclaim deed), which commission shall be deemed to have been <br />earned only upon the closing of said sale. <br />5. On the Date of Closing Seller shall deliver to Buyer <br />its affidavit stating that no contribution of labor or materials <br />has been provided by or furnished at the instance or request of <br />Seller on or to the subject premises for which payment has not <br />been made. <br />6. Title to the subject premises to be conveyed by <br />Seller to Buyer shall also be subject to the following exceptio s: <br />a. The last half of real estate taxes and install- ` ments of special assessments payable in the year L9395, �9 <br />and all taxes and assessments payable thereafter. <br />i <br />b. Casement for County Road C over the South 33 <br />feet of the subject premises. <br />C. Possible water line easement along <br />Westerly 10 feet of the subject s set Part of the <br />in Quit Claim Deed dated November 1976, recorded <br />h <br />January 3, 1977 as Document No. 1954272. <br />d. Easement for a public road and highway and for <br />underground utility purposes under and across the north <br />10 feet of the south 43 feet of the subject premises as <br />per easement dated July 26, 1972, recorded August 8, <br />1912 as Document N <br />o. 1833374. <br />e. Easement to be created for access over the <br />existing driveway located along the westerly boundary <br />of the subject premises. <br />f . Terns and conditions of Agreement, dated <br />October 134, 19800, recorded as Document no. 2096070. <br />7. Notwithstanding any <br />contrary, Seller's obligation to <br />Purchase Agreement is contingent <br />expense, premium or charge, prior <br />following: <br />2 <br />provision herein to the <br />perform the terms of this <br />upon Seller obtaining, without <br />to the Date of Closing, the <br />
