ADDENDUM TO PURCHASE AGPMIENT <br />The undersigned parties to the Purchase Agreement dated March , 1984, <br />on the property located at 2535 West County Road C in Roseville, Minnesota, <br />hereby mutually agree to supplement said Contract as follows: <br />1. This purchase agreement is contingent upon the buyers also entering <br />into purchase agreements with the owners of the following described <br />lands: <br />a. The East two acres of the West 11 acres of the SA- of the <br />SW4 of Section 5, Township 29, Range 23, Ramsey County. <br />(owned by Anthony and Evelyn Marabella, and located at <br />2525 West County Road C in Roseville.) <br />b. The South 750 feet of the West 130± feet of the SA of the <br />SW4 of Section 5, Township 29, Range 23, Ramsey County. - <br />,(owned in fee by the First National Bank of St. Paul with <br />the contract purchaser being Vertimag Systems rporation; <br />located at 2545 West County Road C.) <br />��� ' <br />If buye have not dvise seller in writing within days of seller's <br />execution of this Agreement that buyers have entered into such purchase <br />agreements with said other owners, thereby removing this contingency,. <br />this Agreement shall b void and earnest money paid herein shall be <br />refunded to buyers , � _ 1Q� P <br />;t:� <br />l� 11 <br />Nv <br />2. This purchase agreement is also contingent upon the following: <br />a. Results of soil borings taken by buyers at their sole expense <br />which prove to buyers' satisfaction that the land is suited <br />for their development plans and that there are no contaminants <br />in the soil which would necessitate removal. If buyers have <br />not advised seller in writing with 45 days of seller's <br />execution of this Agreement that buyers are satisfied with <br />said soil boring results, thereby removing this contingency, <br />this Agreement shall be void and earnest money paid herein <br />shall be refunded to buyers. <br />b. Approval by the City of Roseville of buyers' concept and <br />development plans, all at buyers' sole expense. If buyers <br />have not advised seller in writing within 80 days of seller's <br />execution of this Agreement that buyers have obtained such <br />approvals, thereby removing this contingency, this Agreement <br />shall be void and earnest money paid herein shall be refunded <br />to buyers. <br />Buyers agree to diligently proceed with all activities and efforts <br />required to obtain necessary tests and approvals. <br />3. Buyers acknowledge that they have examined the buildings on said <br />property and have determined to buy them in "as is" condition relying <br />solely on their own inspection and judgment. Seller makes no repre- <br />sentation or warranty concerning the buildings, the land or condition <br />of the soil. <br />-1- <br />
