McCarty <br />1894 County Road C-2 <br />Roseville, Minnesota 55113 <br />[NATURAL RESOURCES <br />Paul, Minnesota 55106 <br />PHONE: _296-7523 <br />RE: P.A. 83-6083, RETAINING WALL/RIPRAP, LANGTON LAKE, (62-49W) <br />CITY OF ROSEVILLE, RAMSEY COUNTY <br />Dear Mr. McCarty: <br />Recent discussions with the City -of Roseville and the Rice Creek <br />Watershed District have resulted in our decision that neither the <br />retaining wall nor the riprap with the clay backfill would be con- <br />x: <br />sistent with DNR regulations. <br />Minnesota Code of Agency Rules (6 MCAR 1.5021 A.l.c.) indicate <br />that "it is the policy of the Department to limit the placement of <br />�r <br />�w <br />any 'fill into public waters...placement in conformance with these <br />rules shall be permitted in the...recovery of shoreland lost by <br />erosion or other natural forces which has occurred within the last <br />five (5) years." We We have no evidence that you have lost any land <br />r <br />to erosion --specifically to the extent evidenced by the location <br />of, the beginnings of your.retaining wall. <br />' <br />` <br />Because the backfill would be detrimental with respect to stormwater <br />retention capabilities of Langton Lake, it is doubtful that we could <br />issue your permit as you have requested. <br />' <br />IfYOU feel you, need erosion protection, we can only allow the use <br />of natural riprap as described in the enclosed pamphlet; i.e., con- <br />' <br />forming to the existing shoreline " " <br />g (shown as deteriorated soil line <br />fx <br />on your sketch --copy enclosed). No DNR permit is required if the <br />dimensions in the pamphlet are complied with.
