<br />REQUEST FOR COUNCIL ACTION <br />Date: 3/4/2024 <br />Item No.: 7.a. <br />Department Approval City Manager Approval <br /> <br /> <br /> <br />Item Description: Conduct Public Hearing to Certify Unpaid Utility Charges to the Property Tax <br />Roll <br />1 <br />2 Background <br />3 As authorized by City Code, Sections 506, 801,802, and 906, the City annually certifies to the County <br />4 Auditor any unpaid false alarms, water, sewer, and other charges that are in excess of 90 days past due, <br />5 for collection on the following year's property taxes. <br />6 <br />7 Beginning in 2010, the City Council began approving certifications for delinquent utilities on a quarterly <br />8 basis. This ensures that any unpaid utilities are brought to the attention of new property owners in a <br />9 more timely fashion. It will also allow the City to record a lien against the property in the event that a <br />10 property goes into foreclosure and/or is being prepared for sale for other reasons. <br />11 <br />12 Attached is the current list of delinquent charges. Payments (along with accrued interest) received by <br />13 the Finance Office prior to February 23, 2024 were accepted and will not be levied on the 2025 property <br />14 taxes. <br />15 <br />16 Based on the City Attorney's advice, a public hearing should be held prior to adoption of the resolution <br />17 certifying the unpaid charges. All persons with delinquent accounts were notified that they can attend <br />18 the City Council meeting on March 4 to dispute the delinquent charges. <br />19 <br />20 Policy Objectives <br />21 Certifying delinquent charges are required under City Code. <br />22 <br />23 Racial Equity Impact Summary <br />24 There is no anticipated racial equity impact. <br />25 <br />26 Budget Implications <br />27 Not Applicable <br />28 <br />29 Staff Recommendations <br />30 Staff recommends holding the public hearing and approval of the attached resolution levying unpaid <br />31 utility and other charges for collection on the property taxes. <br />32 <br />33 Requested Council Action <br />34 Motion adopting the resolution approving the certification of unpaid utility and other charges to the <br />35 County Auditor for collection on the property taxes. <br />36 <br />Page 1 of 2 <br />Qbhf!4!pg!342 <br /> <br />
