<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 2/26/2024 <br />Item No.: 10.f. <br />Department Approval City Manager Approval <br /> <br />Item Description: Approve the Rice Creek Watershed District Programmatic <br />Maintenance Agreement Update <br />1 <br />2 Background <br />3 The City of Roseville and the Rice Creek Watershed District (RCWD) work together on a <br />4 variety of projects which impact the construction, maintenance, and operation of our <br />5 stormwater infrastructure. The RCWD also has permit requirements that require the City to <br />6 install stormwater infrastructure to mitigate impacts created by expanding impervious <br />7 surface, infringing on flood plains or wetlands, modifying public drainage, or one of several <br />8 other regulated items. <br />9 <br />10 As part of the RCWD permit process, long term maintenance of the infrastructure is a <br />11 requirement. To make the permit process smoother, the RCWD allows municipalities to <br />12 enter into a Programmatic Maintenance Agreement that identifies what activities are <br />13 required for permitted projects. This Programmatic Maintenance Agreement provides the <br />14 City with an opportunity to only have to reference our existing agreement with the RCWD <br />15 when applying for a permit, in lieu of having to create a standalone maintenance plan for <br />16 each of our projects. Roseville entered into a Programmatic Maintenance Agreement with <br />17 the RCWD in 2015 (Attachment 1). The agreement was specifically for RCWD’s Rule C, <br />18 which pertains to stormwater best management practice maintenance. The existing <br />19 agreement has no specified termination date. RCWD keeps their maintenance agreements <br />20 open ended as the infrastructure that is in place has to be maintained for perpetuity. <br />21 <br />22 With the City’s proposed Twin Lakes Trail Phase II project, the City will be modifying a <br />23 Regional Conveyance System (Rule G) and modifying a Public Drainage System (Rule I), <br />24 which are managed by the RCWD. The permitting process will require that the City <br />25 maintain our box culvert long term, which is covered by both Rule G and Rule I. This <br />26 updated agreement also has no end date, which is the same as our 2015 maintenance <br />27 agreement. <br />28 <br />29 City staff proposed to the RCWD a modification of our existing Rule C Programmatic <br />30 Maintenance Agreement to an agreement that will cover Rules C, G & I (Attachment 2). <br />31 This agreement will define our roles and responsibilities long term, and will allow staff to <br />32 permit the project by referencing this update agreement in lieu of creating a standalone <br />33 maintenance plan that will need to be updated. <br />Page 1 of 2 <br />Qbhf!2:2!pg!335 <br /> <br />
