PROGRAMMATIC STORMWATER MANAGEMENT FACILITY and WATERBODY/CHANNEL <br />IMPROVEMENT MAINTENANCE AGREEMENT <br />Waterbody/Channel Structure <br />(Amending by Replacement July 16, 2015 Agreement) <br />Rice Creek Watershed District and the City of Roseville <br />This Agreement is by and between the Rice Creek Watershed District, a special purpose unit of <br />government with powers set forth in Minnesota Statutes Chapters 103B, 103D and 103E (RCWD), and <br />the City of Roseville, a Public Municipal Corporation under the laws of the State of Minnesota (CITY). <br />Recitals <br />WHEREAS pursuant to Minnesota Statutes § 103D.345, the RCWD has adopted and implements Rule C, <br />Stormwater Management Plans; <br />WHEREAS under Rule C, certain land development activity requires a landowner to record a declaration <br />facilities; <br />WHEREAS pursuant to Minnesota Statutes § 103D.345, the RCWD has adopted and implements Rules G <br />(Regional Conveyance Systems) and I (Drainage Systems); <br />WHEREAS under Rules G and I, a permit for a structure or improvement within or adjacent to a regional <br />conveyance system or public drainage system requires a landowner to record a declaration establishing <br />mprovement; <br />WHEREAS a public landowner may memorialize its obligations in an unrecorded written agreement with <br />the RCWD instead of a recorded instrument; <br />WHEREAS the CITY is subject from time to time to maintenance requirements pursuant to the terms of <br />an RCWD permit; <br />WHEREAS the RCWD and CITY concur that it is more effective and procedurally more efficient for the <br />RCWD and CITY to agree on standard requirements for inspection and maintenance, and to memorialize <br />these requirements in this Agreement for incorporation into future permits; and <br />facility maintenance in accordance with its terms, and extends it to maintenance of structures and <br />improvements in regional conveyance and public drainage systems. <br />THEREFORE: <br />1.CITY will inspect and maintain all stormwater best management practices (BMPs), that have been <br />permitted by the RCWD under Rule C as follows: <br />1 <br />Qbhf!2:8!pg!335 <br /> <br />
