<br />REQUEST FOR COUNCIL ACTION <br />Date: 2/26/2024 <br />Item No.: 7.b. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider Ordinance Amending Chapter 407 of Roseville City Code, <br />Abatement of Public Nuisances <br />1 <br />2 Background <br />3 Chapter 407 of the Roseville City Code deals with nuisances and enforcement. Currently, <br />4 the City Code gives the Community Development Director, or their designee, the authority <br />5 to enforce these issues. The Public Works Department also deals with a variety of <br />6 problems that can lead to public nuisances. Some examples of nuisances that Public <br />7 Works deals with include private water main breaks or water service leaks that are not <br />8 repaired by the owner, private hydrant or valve repairs, or defective sewer drains. <br />9 <br />10 The proposed changes to section 407.06 and 407.07 allow the Public Works Director to <br />11 enforce nuisance issues within the right-of-way. The overall process would be the exact <br />12 same as when Community Development brings forward nuisance abatements. The process <br />13 would allow the City to complete repairs as needed and allow the City to assess the cost to <br />14 the property owner. <br />15 <br />16 Staff presented the amended Public Works ordinance to the Public Works Environment and <br />17 Transportation Commission on January 23. After some discussion and recommendations, <br />18 the Commission recommended that the City Council adopt the proposed ordinance <br />19 amendment as amended. (Attachment 1). <br />20 <br />21 The City Attorney helped draft and reviewed the proposed ordinance. <br />22 <br />23 Policy Objectives <br />24 It is City policy to keep City-owned infrastructure in good operating condition and to keep <br />25 systems operating in a safe condition. <br />26 <br />27 Racial Equity Impact Summary <br />28 There should be no equity impacts. <br />29 <br />30 Budget Implications <br />31 The ordinance amendments should have no overall impacts financially.
