1 City of Roseville <br />2 ORDINANCE NO. <br />3 <br />4 AN ORDINANCE AMENDING <br />5 <br />6 TITLE 7, CHAPTER 707 <br />7 <br />8 AMENDING TITLE 7, CHAPTER 707 OF THE ROSEVILLE CITY CODE TO <br />9 CLARIFY PERMIT AND RESTORATION REQUIRMENTS <br />10 FOR WORK DONE IN THE RIGHT-OF-WAY <br />11 <br />12 THE CITY OF ROSEVILLE ORDAINS: <br />13 <br />14 SECTION 1: Title 7, Section 707.02 of the Roseville City Code is amended to <br />15 read as follows: <br />16 707.02: DEFINITIONS: <br />17 The following definitions apply in this Chapter. References hereafter to "sections" are, unless <br />18 otherwise specified, references to sections in this Chapter. Defined terms remain defined terms <br />19 whether or not capitalized. <br />20 APPLICANT: Any person requesting permission to excavate or obstruct a right of way. <br />21 BUSINESS DISTRICT: That portion of the City lying within and bounded by the following <br />22 streets: to be subsequently designated. <br />23 CITY: The City of Roseville, Minnesota. For purposes of Section 707.28 of this Chapter, City <br />24 means its elected officials, officers, employees and agents. <br />25 COLLOCATE or COLLOCATION: To install, mount, maintain, modify, operate, or replace a <br />26 small wireless facility on, under, within, or adjacent to an existing wireless support structure or <br />27 utility pole that is owned privately, or by the city or other governmental unit. (Ord. 1549, 4-9- <br />28 2018) <br />29 DEGRADATION: A decrease in the useful life of the right of way caused by excavation in or <br />30 disturbance of the right of way, resulting in the need to reconstruct such right of way earlier than <br />31 would be required if the excavation did not occur. <br />32 DEGRADATION COST: The cost to achieve a level of restoration as determined by the City at <br />33 the time the permit is issued, not to exceed the maximum restoration shown in plates 1 to 13, set <br />34 forth in proposed PUC rules parts 7819.9900 to 7819.9950. <br />35 DEGRADATION FEE: The estimated fee established at the time of permitting by the City to <br />36 recover costs associated with the decrease in the useful life of the right of way caused by the <br />37 excavation, and which equals the degradation costs. <br />38 DELAY PENALTY: The penalty imposed as a result of unreasonable delays in right-of-way <br />39 construction. <br />1 <br />RS160\\1\\928687.v2 <br />Qbhf!55!pg!335 <br /> <br />
