<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 2/26/2024 <br />Item No.: 7.f. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider Ordinance Amending Chapter 703 of Roseville City Code, <br />Courtesy Benches <br />1 <br />2 Background <br />3 Chapter 703.05 of the Roseville City Code deals with bus benches in the rights-of-way. <br />4 nuisances and enforcement. The code was last updated in 2008. Some of the current <br />5 ordinance language is out of date and needs updating. Currently, the City has one vendor, <br />6 US Bench, which has 51 benches installed throughout the City at current or former transit <br />7 stops. <br />8 <br />9 Staff reviewed numerous other city ordinances in regards to benches in public rights-of- <br />10 way. Based on these ordinances as well as feedback from the Public Works Environment <br />11 and Transportation Commission (Attachment 3) and the City Attorney, staff is <br />12 recommending the following changes be made to the current ordinance: <br />13 Change the term “Bus Bench” to “Courtesy Bench.” <br />14 Require a license for each Courtesy Bench and outline licensing requirements and <br />15 regulations. <br />16 o Change to two-year license to limit administrative time, since locations <br />17 change infrequently. <br />18 Outline locations where Courtesy Benches may be placed. <br />19 o Proposed ordinance would allow benches if adjacent to city pathway. <br />20 Clarifies specific requirements of benches for advertising and ADA compliance. <br />21 Updates liability insurance. <br />22 Overall, the proposed ordinance simplifies the licensing process and clarifies bench <br />23 requirements to more industry-wide standards. The only major change is allowing benches <br />24 along pathways, which the current code does not allow. <br />25 <br />26 The City Attorney helped draft and reviewed the proposed ordinance. <br />27 <br />28 Policy Objectives <br />29 It is City policy to keep City-owned infrastructure in good operating condition and to keep <br />30 systems operating in a safe condition. <br />31 <br />Page 1 of 2 <br />Qbhf!95!pg!335 <br /> <br />
