<br />REQUEST FOR COUNCIL ACTION <br />Date: 1/29/2024 <br />Item No.: 10.g. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Approve Memorandums of Understanding with LELS unions <br />representing Police Lieutenants and Sergeants regarding Earned Sick <br />and Safe Time <br />1 <br />2 Background <br />3 The Minnesota Legislature recently passed a law mandating Earned Sick and Safe Time (ESST) <br />4 benefits for all eligible employees. The city must comply with the new legislation. The city has updated <br />5 its leave policies to reflect this change and comply with the requirements of the new law, and therefore <br />6 an update to the collective bargaining agreements for employees that are on the Vacation/Sick leave <br />7 accrual system is required. The city has already negotiated these provisions for the union representing <br />8 Police Officers in the contract recently ratified by the Council. Because there are two other bargaining <br />9 units whose contracts do not expire until the end of 2024, the city is seeking to enter into a <br />10 Memorandum of Understanding between the city and union. The attached Memorandums of <br />11 Understanding (MOUs) are intended to establish clear guidelines and provisions for the implementation <br />12 of ESST in alignment with state law for the following bargaining units: <br />13 Law Enforcement Labor Services (LELS) Local 436 - Police Sergeants <br />14 Law Enforcement Labor Services (LELS) Local 431 - Police Lieutenants <br />15 The other bargaining units within the city are on the Paid Time Off (PTO) accrual system and since this <br />16 leave can be used for any purpose, including Earned Sick and Safe Time, an MOU is not necessary. <br />17 <br />18 Policy Objectives <br />19 The primary objective of the proposed MOUs is to ensure the seamless integration of Earned Sick and <br />20 Safe Time benefits for Police Lieutenants and Sergeants, as mandated by the recent legislation. The <br />21 MOUs outline the terms and conditions under which ESST will be accrued, utilized, and managed, <br />22 reflecting the city's commitment to compliance with state law while prioritizing the well-being of law <br />23 enforcement personnel. <br />24 <br />25 Racial Equity Impact Summary <br />26 The implementation of Earned Sick and Safe Time promotes racial equity by ensuring all employees, <br />27 regardless of their racial or ethnic background have equitable access to paid leave. Historically certain <br />28 racial and ethnic groups have faced disparities in accessing essential workplace benefits. The statewide <br />29 implementation of ESST aims to reduce these disparities by providing a standardized and inclusive <br />30 framework for paid leave, fostering greater economic and social equality. Although the city already offers <br />31 paid leave to all benefit-eligible positions, this will ensure the city is in compliance with state law. <br />32 <br />33 Budget Implications <br />34 There are no budget implications. The city already offers paid Vacation/Sick leave to the employees in <br />35 these bargaining units.
