<br />MEMORANDUM OF UNDERSTANDING <br />CITY OF ROSEVILLE AND LAW ENFORCEMENT LABOR SERVICES, INC. LOCAL NO.431 <br />Safe and Sick Time <br />This Memorandum of Understanding sets forth the mutual agreement between the City of <br /> Roseville (“City”) and Law Enforcement Labor Services, Inc. Local No. 431 (hereafter “Union”) <br />regarding the use of sick leave to comply with the provision of Sick and Safe Time as defined in <br /> Minnesota Statutes 181.9445, 181.9446, 181.9447, and 181.9448 (“the Statutes”) with an <br />effective date of January 1, 2024 and repealed Minnesota Statute 181.9413. <br /> WHEREAS, the City and the Union are parties to a Collective Bargaining Agreement (“CBA”) in <br />effect from January 1, 2022, through December 31, 2024, covering Police Lieutenants in the <br />Roseville Police Department and setting forth terms and conditions of employment, including <br />sick leave (Article 24); <br />WHEREAS, in 2023 the Minnesota legislature enacted legislation mandating the provision of <br /> Sick and Safe Time—Minnesota Statutes 181.9445, 181.9446, 181.9447, and 181.9448 (“the <br /> Statutes”) with an effective date of January 1, 2024 and repealed Minnesota Statute 181.9413; <br />and <br /> WHEREAS, Article 24 contains provisions that go beyond the Statute’s minimum requirements, <br />is silent as to certain requirements in the Statutes, and contains provisions that are contrary to <br />the Statutes; <br />WHEREAS, the parties now wish to amend the current CBA regarding sick leave and agree as <br />follows: <br /> 1.Article XXIV – Sick Leave is repealed and replaced with the following: <br />Regular full-time employees shall earn sick leave at a rate of 3.693 hours per pay <br />period. Sick leave may be carried over from year to year. Sick leave may be used for <br /> any purpose permitted by the Employer’s Earned Sick and Safe Time (“ESST”) Policy, <br />which is consistent with and satisfies the requirements of Minnesota Statutes <br />§§181.9445, 181.9446, 181.9447, and 181.9448. <br /> 2.All other terms and conditions of the parties’ 2022-2024 Collective Bargaining <br />Agreement shall remain in full force and effect. <br />IN WITNESS WHEREOF, the parties have executed this Memorandum of Understanding on the <br />dates set forth by their respective signatures. <br />Qbhf!268!pg!367 <br /> <br />
