<br />129 issue, renew nor revoke the license or permit for any reason and will not incur <br />130 liability for any damages including, but not limited to, direct, consequential <br />131 or incidental damages, deprivation of property, loss of income, loss of profits <br />132 or loss of livelihood. <br />133 <br />134 304.04 PENALTY FOR VIOLATION <br />135 <br />136 A.Any violation by the organization of any state statute, state rule, or city <br />137 ordinance relating to gambling may be penalized by issuance of a fine, <br />138 imposition of reasonable conditions on the premises permit, suspension of <br />139 the premises permit, or revocation of the premises permit. Such a penalty <br />140 may only be imposed following full notice of the allegations, the proposed <br />141 penalty, and an opportunity to be heard regarding the allegations and the <br />142 imposition of the penalty. <br />143 <br />144 B.In addition, violations shall be reported to the Board and a recommendation <br />145 shall be made by the city for suspension, revocation, or cancellation of an <br />146 organization’s license. <br />147 <br />148 304.045: CONTRIBUTIONS: <br />149 <br />150 A.Each organization conducting lawful gambling within the city shall <br />151 contribute at least 10% of its net profits derived from lawful gambling in the <br />152 city to a Fund administered and regulated by the city without cost to the fund. <br />153 This contribution shall be for the purposes defined in Minnesota Statutes <br />154 Chapter 349. Except for Disbursements for police, fire, and other emergency <br />155 or public safety-related services, as provided for in Minnesota Statutes <br />156 Chapter 349, which shall be made directly from the Fund by action of the <br />157 City Council., The city then shall will make disbursements of the remaining <br />158 amounts from the Fund to the Roseville Area Community Foundation a <br />159 Minnesota nonprofit corporation, which shall maintain the funds for further <br />160 disbursement as charitable contributions permitted under Minnesota Statute <br />161 Chapter 349. The city's directive to the Roseville Area Community <br />162 Foundation as to the use of the funds shall be provided for in a written formal <br />163 agreement executed between the city and the Foundation, and approved by <br />164 the City Council, as amended form time to time. <br />165 <br />166 B.The Roseville Area Community Foundation shall provide an annual report to <br />167 the City Council in writing and by oral presentation, outlining the financial <br />168 condition of the city funds, including changes since the previous report, and <br />169 the names of the recipients, purposes, and, as available, outcomes of <br />170 charitable contributions from the city funds since the previous report. <br />171 <br />RS160\\1\\920171.v1 <br />Qbhf!26!pg!413 <br /> <br />
