129 issue, renew nor revoke the license or permit for any reason and will not incur 130 liability for any damages including, but not limited to, direct, consequential 131 or incidental damages, deprivation of property, loss of income, loss of profits 132 or loss of livelihood. 133 134 304.04 PENALTY FOR VIOLATION 135 136 A.Any violation by the organization of any state statute, state rule, or city 137 ordinance relating to gambling may be penalized by issuance of a fine, 138 imposition of reasonable conditions on the premises permit, suspension of 139 the premises permit, or revocation of the premises permit. Such a penalty 140 may only be imposed following full notice of the allegations, the proposed 141 penalty, and an opportunity to be heard regarding the allegations and the 142 imposition of the penalty. 143 144 B.In addition, violations shall be reported to the Board and a recommendation 145 shall be made by the city for suspension, revocation, or cancellation of an 146 organization’s license. 147 148 304.045: CONTRIBUTIONS: 149 150 A.Each organization conducting lawful gambling within the city shall 151 contribute at least 10% of its net profits derived from lawful gambling in the 152 city to a Fund administered and regulated by the city without cost to the fund. 153 This contribution shall be for the purposes defined in Minnesota Statutes 154 Chapter 349. Except for Disbursements for police, fire, and other emergency 155 or public safety-related services, as provided for in Minnesota Statutes 156 Chapter 349, which shall be made directly from the Fund by action of the 157 City Council., The city then shall will make disbursements of the remaining 158 amounts from the Fund to the Roseville Area Community Foundation a 159 Minnesota nonprofit corporation, which shall maintain the funds for further 160 disbursement as charitable contributions permitted under Minnesota Statute 161 Chapter 349. The city's directive to the Roseville Area Community 162 Foundation as to the use of the funds shall be provided for in a written formal 163 agreement executed between the city and the Foundation, and approved by 164 the City Council, as amended form time to time. 165 166 B.The Roseville Area Community Foundation shall provide an annual report to 167 the City Council in writing and by oral presentation, outlining the financial 168 condition of the city funds, including changes since the previous report, and 169 the names of the recipients, purposes, and, as available, outcomes of 170 charitable contributions from the city funds since the previous report. 171 RS160\\1\\920171.v1 Qbhf!26!pg!413
