Regular City Council Meeting
Monday,May 6, 2024
Page 17
Deputy Chief Joe Adams briefly highlighted this item as detailed in the Request for
Council Action and related attachments dated May 6, 2024.
There was no representative from Portillos at the meeting.
Councilmember Groff indicated the person involved in this violation was originally
from Taiwan, and he wondered if there was any possibility of a language barrier
that Deputy Chief Adams knows of.
Deputy Chief Adams indicated he did not think so. He did feel like there would be
a note in the case of an interpreter if one had been needed.
Public Comment
Mayor Roe offered an opportunity for public comment with no one coming
forward.
Groff moved, Schroeder seconded, approval to issue and administer the
presumptive penalty pursuant to City Code Section 302.15, for on-sale license
holders for the second violation within thirty-six (36) months and a mandatory
minimum penalty of two thousand dollars ($2,000.00) fine and a five (5) day
suspension.
Council Discussion
Councilmember Schroeder explained this is only four months between the two
violations, which was a little disturbing. She would hope that the training would
still be there.
Councilmember Etten appreciated Councilmember Groff bringing up the question
regarding a possible language barrier, which is always something they should be
aware of. Also, the training should address which way the license is situated and
something that should be thought about.
Roll Call
Ayes: Etten, Schroeder, Groff, Strahan, and Roe.
Nays: None
h.
