EXTRACT OF MINUTES OF MEETING <br /> OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br /> Roseville, County of Ramsey, Minnesota was duly held on the 17th day of June, 2024, at <br /> 6:00 p.m. <br /> The following members were present: Etten, Groff, Strahan, Schroeder, and Mayor Roe. <br /> and the following were absent: None. <br /> Member Groff introduced the following resolution and moved its adoption: <br /> RESOLUTION No. 12076 <br /> RESOLUTION OF DECISION OF THE BOARD OF ADJUSTMENTS AND APPEALS <br /> CONCERNING THE APPEAL BY ERIC CARRARA OF 257 SOUTH MCCARRONS <br /> BOULEVARD TO REVOCATION OF A FENCE PERMIT <br /> AND ORDER TO REMOVE A FENCE <br /> WHEREAS, on November 8, 2023, Property owner, Eric Carrara, made application for a <br /> fence permit to construct a six-foot privacy fence at 257 South McCarrons Boulevard (the <br /> "Property"); and <br /> WHEREAS, the permit application included a site plan that did not identify the location <br /> of property lines or right-of-way lines; and <br /> WHEREAS,had the site plan identified the location of property lines and right-of-way <br /> lines, it would have shown that the fence was to be constructed in City right-of-way; and <br /> WHEREAS, in order to construct in the right-of-way, the Roseville City Code Section <br /> 707.08 requires a permit to obstruct the right-of-way, and the City also requires an encroachment <br /> agreement between the applicant and the City; and <br /> WHEREAS, the applicant did not obtain a right-of-way permit and the applicant did not <br /> enter into an encroachment agreement with the City; and <br /> WHEREAS, the site plan depicted a front-yard fence which the application stated was to <br /> "replace existing city fence with a 6ft standard privacy fence"; and <br /> WHEREAS, in accordance with Zoning Code Section 1011.08 fences in front yards may <br /> not exceed four feet in height; and <br /> WHEREAS, the applicant did not obtain a variance in order to build a front-yard fence <br /> taller than four feet; and <br /> WHEREAS, on March 12, 2024, City staff approved the permit application; and <br />
