<br />REQUEST FOR COUNCIL ACTION <br />Date: 5/20/2024 <br />Item No.: 10.f. <br />Department Approval City Manager Approval <br /> <br />Item Description: Memorandum of Understanding for the 2377 County Road B <br />Temporary Construction Easement <br />1 <br />2 Background <br />3 The reconstruction of County Road B, west of Cleveland Avenue, does not need acquisition <br />4 of any permanent easements. However, a temporary construction easement is needed at <br />5 2377 County Road B to allow for the construction of the new off-road pathway that <br />6 connects to the new city park, also under construction this year. The property owner will be <br />7 compensated $750.00 for the use of this land during construction. An agreement for the <br />8 easement will be signed by the property owners, but a memorandum of understanding <br />9(MOU) to document the monetary compensation needs Council action. <br />10 <br />11 After construction, the temporary easement will expire. The City Attorney has reviewed the <br />12 MOU. <br />13 <br />14 Policy Objectives <br />15 It is City policy to keep City-owned infrastructure in good operating condition and to keep <br />16 systems operating in a safe condition. <br />17 <br />18 Racial Equity Impact Summary <br />19 There should be no equity impacts associated with this agreement. <br />20 <br />21 Budget Implications <br />22 The approved project budget will cover the costs associated with the easement. <br />23 <br />24 Staff Recommendations <br />25 Staff recommends the City Council approve the Memorandum of Understanding for the <br />26 2377 County Road B Temporary Construction Easement. <br />27 <br />28 Requested Council Action <br />29 Motion to approve the Memorandum of Understanding for the 2377 County Road B <br />30 Temporary Construction Easement. <br />31 <br />32 <br />Page 1 of 2 <br />Qbhf!232!pg!257 <br /> <br />
